North Dakota Home Approves Marijuana Legalization Act (HB 1420)

The North Dakota House of Representatives passed a bill to legalize marijuana this Tuesday.

House Bill (HB) 1420 would allow the sale and possession of cannabis for adults aged 21 and over. However, growing marijuana for personal use remains illegal. According to the law, legal marijuana sales are scheduled to begin on July 1, 2022

This coincides with the fact that state lawmakers passed several changes last week, including a reform of North Dakota’s medical marijuana program that allows up to 21 grams of cannabis to be sold to medical patients, but lifts the legal transport limit one ounce sets.

State Republicans’ Views on Cannabis

HB 1420 was sponsored by Republican legislature Jason Dockter. Although he is against the legalization of cannabis, he has realized that the issue is not whether marijuana will be legalized in North Dakota, but when.

“[Marijuana legalization] come in – it’s already there, ”he said to HB 1420 during the House Floor Session on Tuesday.

Dockter’s rationale for proposing the legislation is to allow state lawmakers to rule on marijuana laws rather than letting marijuana advocates rule them through an electoral initiative.

Other state Republicans have also accepted the impending legalization. House majority leader Chet Pollert (R), who previously stated he was not a “marijuana person,” spoke out in favor of marijuana legalization after seeing the success of South Dakota’s marijuana election initiatives in November 2020 , and Representative Matthew Ruby (R) has confirmed Dockter’s sentiments regarding cannabis legalization.

What’s Next for North Dakota Marijuana Legalization?

While HB 1420 was walking around the house, Representative Shannon Roers Jones (R) was passing a bill that would expand the decriminalization of marijuana law passed in North Dakota in 2019. However, if broader legalization is approved in the North Dakota Legislature, Jones has urged lawmakers to reject their bill.

HB 1420 will now be forwarded to the Senate, where another voting round will take place. If approved, it will be forwarded to Governor Doug Burgum (R) for final decision.
